Failure to diagnose a herniated disk does not make him a 'jerk'.   The only way to diagnose a herniated disc is essentially with an MRI.  Emergency Departments don't typically perform these studies because there is no such thing as an 'emergent' herniated disc.  It is a non-emergent condition.  If the doctor treated your pain and gave you appropriate outpatient referral for your back pain, then he has done everything within the spectrum and responsibility of an EMERGENCY physician, and is probably not the 'jerk' you think he is.
